SELF-EMPLOYMENT AND TAX

Late tax return in Spain: a surcharge if you file on your own, a possible penalty if the tax agency acts first

For: self-employed people and individuals who file self-assessments or returns with the Spanish Tax Agency (AEAT), such as Modelo 303, 130 or 349 or the annual income tax return. When: after the deadline, if you did not file on time or the tax agency has already acted on that return. What it covers: the line between a late-filing surcharge (recargo) and a penalty (sanción) is the prior request from the tax agency (requerimiento previo); if you file before it, you pay a surcharge of 1% plus 1% per full month of delay, or 15% plus late-payment interest after 12 months; if you file after it, the surcharge no longer applies and the unpaid tax can be penalised.

The line is the prior request: file before it and you pay a surcharge, not a penalty

If the return shows tax to pay and you file it before any prior request from the tax agency, you pay a surcharge, not a penalty.
This is how art. 27.1 of the General Tax Law (LGT) defines it:
(“Late-filing surcharges are ancillary payments that taxpayers must make as a result of filing self-assessments or returns late without a prior request from the tax authority.”)
What counts as a prior request, under the same article:
(“For the purposes of this article, a prior request is any administrative action carried out with the taxpayer’s formal knowledge
and aimed at recognising, regularising, verifying, inspecting, securing or assessing the tax debt.”) (art. 27.1 LGT)
What the surcharge is not: it is not a penalty, but it is not free either.
If filing late causes no financial loss to the Public Treasury (Hacienda Pública), a different rule applies: a fixed penalty (section 3).

Within 12 months: 1% plus 1% per full month, with no penalty or interest; after that: 15% plus late-payment interest

The surcharge depends on how many full months have passed since the deadline.
(“The surcharge is 1% plus an extra 1% for each full month of delay in filing the self-assessment or return after the filing and payment deadline.”) (art. 27.2 LGT)
That surcharge:
(“is calculated on the amount payable under the self-assessment, or on the amount assessed from the late return,
and excludes any penalties that could have been imposed and the late-payment interest accrued up to the date of filing.”) (art. 27.2 LGT)
After 12 months:
(“If the self-assessment or return is filed once 12 months have passed since the filing deadline,
the surcharge is 15% and excludes any penalties that could have been imposed.”) (art. 27.2 LGT)
(“In these cases, late-payment interest is charged from the day after the end of the 12 months following the filing deadline
until the self-assessment or return is filed.”) (art. 27.2 LGT)
The surcharge can be reduced by 25%: the conditions are in the table in section 2.

1. What you pay depends on the months of delay, the prior request, the result of the return and how you pay

Answer these in order. If what you missed was your residence renewal rather than a tax, that is a different procedure: late residence renewal.

  • How many full months have passed since the deadline? They set the surcharge percentage and the late-payment interest (second question).
  • Has the tax agency already taken any action on this return with your formal knowledge? If it is a prior request, read section 4.
  • Does the return show tax to pay? If it does, the surcharge applies. If the delay causes no financial loss to the Public Treasury, the fixed penalty in section 3 applies.
  • Can you pay everything at once? The surcharge reduction depends on it (section 2). If you cannot, section 5 explains deferral and which debts do not qualify.

2. Who acts first and whether tax is due decide what you pay

Each situation, with the article of the General Tax Law (LGT) that governs it.

Situation and consequence
SituationWhat appliesRule
You file on your own, with no prior request, with tax to pay, within 12 months of the deadlineSurcharge of 1% plus 1% per full month; no penalty and no late-payment interest up to the date you fileArt. 27.1 and 27.2 LGT
Same, but after 12 monthsSurcharge of 15%, no penalty; late-payment interest from the day after those 12 months until you fileArt. 27.2 LGT
You pay the tax and the surcharge within the periods in art. 27.5Surcharge reduced by 25%Art. 27.5 LGT
You file late with no financial loss to the Public TreasuryFixed penalty of €200 (€400 for census returns or the notice appointing a representative); half if you file with no prior requestArt. 198.1 and 198.2 LGT
You do not pay the tax a correct self-assessment would show and do not regularise it under art. 27Offence with a proportional penalty: 50% (minor), 50% to 100% (serious), 100% to 150% (very serious)Art. 191 LGT
You have already been penalisedReduction of 65% (settlement record, acta con acuerdo) or 30% (agreement, conformidad). A further 40% if you pay on time and do not appeal, applied after any agreement reduction; this 40% does not apply to penalties from settlement recordsArt. 188.1 and 188.3 LGT

3. If the delay causes no financial loss: a fixed penalty

Art. 198 LGT penalises late filing when there is no financial loss; filing with no prior request halves the penalty.

(“Failing to file self-assessments or returns on time, and documents related to customs obligations, is a tax offence provided that no financial loss has been or can be caused to the Public Treasury.” “The offence in this paragraph is minor.”) (art. 198.1 LGT)
(“The penalty is a fixed monetary penalty of €200 or, for census returns or the notice appointing the representative of persons or entities where the rules so require, €400.”) (art. 198.1 LGT)
  • If you file with no prior request: «No obstante lo dispuesto en el apartado anterior, si las autoliquidaciones o declaraciones se presentan fuera de plazo sin requerimiento previo de la Administración tributaria, la sanción y los límites mínimo y máximo serán la mitad de los previstos en el apartado anterior.» (“Notwithstanding the previous paragraph, if self-assessments or returns are filed late without a prior request from the tax authority, the penalty and its minimum and maximum limits are half of those in the previous paragraph.”) (art. 198.2 LGT)
  • Informative returns have their own penalty rules in the same art. 198.1 LGT.

4. If there is already a prior request: respond before the assessment and pay on time to reduce the penalty

Warning: if the tax agency has already taken an action that art. 27.1 LGT treats as a prior request (first question), you are no longer filing «sin requerimiento previo de la Administración tributaria» (“without a prior request from the tax authority”). The art. 27 surcharge stops applying and the unpaid tax can be penalised (art. 191.1 LGT).

  • Before assessing, the tax agency sends you a proposal. (“Before issuing the provisional assessment, the tax authority must send the taxpayer the proposed assessment so that they can put forward whatever supports their case.”) (arts. 132.3 and 138.3 LGT)
  • Time to respond in procedures where you reply after the proposal: «El trámite de alegaciones no podrá tener una duración inferior a 10 días ni superior a 15.» (“The period for submitting arguments may not be shorter than 10 days or longer than 15.”) (art. 99.8 LGT)
(“a) If the assessment is notified between the 1st and the 15th of the month: from the date the notice is received until the 20th of the following month or, if that is not a working day, the next working day.” “b) If the assessment is notified between the 16th and the last day of the month: from the date the notice is received until the 5th of the second following month or, if that is not a working day, the next working day.”) (art. 62.2 LGT)
(“Monetary penalties imposed under articles 191 to 197 of this Law are reduced by the following percentages:” “a) 65% in the case of settlement records (actas con acuerdo) under article 155 of this Law.” “b) 30% where the taxpayer agrees (conformidad).”) (art. 188.1 LGT)
(“The penalty payable for any offence, after any agreement reduction under paragraph 1(b) of this article, is reduced by 40% if the following conditions are met:” “a) The rest of the penalty is paid in full within the period in article 62(2) of this Law, or within the period or periods set in a deferral or instalment agreement that the tax authority granted with a bank guarantee or surety insurance certificate and that the payer requested before the period in article 62(2) of this Law ended.” “b) No appeal or claim is lodged against the assessment or the penalty.”) (art. 188.3 LGT)

5. If you cannot pay in one go: apply for deferral before the voluntary period ends

Before applying, check that your debt is not on the list in art. 65.2 LGT: if it is, the application is not admitted.

  • Debts that cannot be deferred (art. (“b) Those arising from tax obligations that the withholding agent or the person required to make payments on account must meet.” “f) Those arising from taxes that must legally be passed on to the customer, unless it is properly shown that the tax passed on has not actually been paid.” “Applications for deferral or payment in instalments covered by the subparagraphs of this paragraph will not be admitted.”)
  • When you can apply: «Las deudas tributarias que se encuentren en período voluntario o ejecutivo podrán aplazarse o fraccionarse en los términos que se fijen reglamentariamente y previa solicitud del obligado tributario, cuando su situación económico-financiera le impida, de forma transitoria, efectuar el pago en los plazos establecidos.» (“Tax debts in the voluntary or enforcement period may be deferred or paid in instalments, on the terms set by regulation and at the taxpayer’s request, when their financial situation temporarily prevents them from paying within the set periods.”) (art. 65.1 LGT)
  • What it gives you and what it does not: «La presentación de una solicitud de aplazamiento o fraccionamiento en período voluntario impedirá el inicio del período ejecutivo, pero no el devengo del interés de demora.» (“Applying for deferral or payment in instalments during the voluntary period prevents the enforcement period from starting, but not late-payment interest from accruing.”) (art. 65.5 LGT)
  • Guarantee: on its deferral page, the tax agency cites «Orden HFP/311/2023, de 28 de marzo,» «por la que se eleva el límite exento de la obligación de aportar garantía en las solicitudes de aplazamiento o fraccionamiento a 50.000 euros.» (“Order HFP/311/2023 of 28 March, which raises to €50,000 the limit up to which applications for deferral or payment in instalments are exempt from providing a guarantee.”)
  • Incomplete application: the tax agency states on that page that, if a requirement or document is missing, it will ask the applicant «para que, en un plazo de 10 días contados a partir del siguiente al de la notificación del requerimiento, subsane el defecto o aporte los documentos con indicación de que, de no atender el requerimiento en el plazo señalado, se tendrá por no presentada la solicitud y se archivará sin más trámite.» (“to correct the defect or provide the documents within 10 days from the day after notification of the request, warning that, if the request is not met within that period, the application will be treated as not filed and closed without further action.”)
  • Deferral and the 25% surcharge reduction: art. 27.5 LGT also grants the reduction «o siempre que se realice el ingreso en el plazo o plazos fijados en el acuerdo de aplazamiento o fraccionamiento de dicha deuda que la Administración tributaria hubiera concedido con garantía de aval o certificado de seguro de caución y que el obligado al pago hubiera solicitado al tiempo de presentar la autoliquidación extemporánea o con anterioridad a la finalización del plazo del apartado 2 del artículo 62 de esta Ley abierto con la notificación de la liquidación resultante de la declaración extemporánea.» (“or provided that payment is made within the period or periods set in the deferral or instalment agreement for that debt, granted by the tax authority with a bank guarantee or surety insurance certificate, which the payer requested when filing the late self-assessment or before the end of the period in article 62(2) of this Law opened by notification of the assessment resulting from the late return.”)

6. The right to assess expires four years from the day after the deadline, unless interrupted

The period, when it starts and what restarts it, in the words of the LGT.

(“The following rights expire after four years:” “a) The authority’s right to determine the tax debt through the relevant assessment.” “b) The authority’s right to demand payment of assessed and self-assessed tax debts.”) (art. 66 LGT)
  • When the right to assess starts running: «En el caso a), desde el día siguiente a aquel en que finalice el plazo reglamentario para presentar la correspondiente declaración o autoliquidación.» (“In case a), from the day after the statutory deadline for filing the relevant return or self-assessment ends.”) (art. 67.1 LGT)
(“The limitation period for the right in article 66(a) of this Law is interrupted:” “a) By any action of the tax authority carried out with the taxpayer’s formal knowledge and aimed at recognising, regularising, verifying, inspecting, securing and assessing all or part of the elements of the relevant tax obligation, even if the action is initially directed at a different tax obligation because the taxpayer filed incorrectly.” “Once interrupted, the limitation period starts again, except as provided in the next paragraph.”) (art. 68.1 and 68.6 LGT)
  • If you hold a residence and self-employment permit (cuenta propia), at renewal: «La oficina de extranjería para la tramitación del procedimiento comprobará de oficio la información sobre que la persona interesada está al corriente en el cumplimiento de sus obligaciones tributarias y de Seguridad Social, así como recabará el certificado de antecedentes penales y el informe policial de los servicios competentes y resolverá.» (“The immigration office handling the procedure will check on its own initiative that the applicant is up to date (al corriente) with their tax and Social Security obligations, will obtain the criminal record certificate and the police report from the competent services, and will decide.”) (art. 86.5 RD 1155/2024). What this means for your renewal: self-employment residence.

What happens if I file Modelo 303 late?

Modelo 303 follows the rules in the table in section 2: a surcharge if it shows tax to pay; the fixed penalty in art. 198 LGT if the delay causes no financial loss.
Before applying to defer that debt, read section 5: it sets out the exclusion in art. 65.2(f) LGT for taxes that must legally be passed on, and its exception.

How much is the penalty for not declaring tax?

If you do not pay the tax and do not regularise it with the surcharge, it is an offence with a proportional penalty.
When there is an offence: «Constituye infracción tributaria dejar de ingresar dentro del plazo establecido en la normativa de cada tributo la totalidad o parte de la deuda tributaria que debiera resultar de la correcta autoliquidación del tributo, salvo que se regularice con arreglo al artículo 27 o proceda la aplicación del párrafo b) del apartado 1 del artículo 161, ambos de esta ley.» (“Failing to pay, within the period set by the rules of each tax, all or part of the tax debt that a correct self-assessment would show is a tax offence, unless it is regularised under article 27 or paragraph 1(b) of article 161 applies, both of this law.”) (art. 191.1 LGT)
(“The offence is minor when the penalty base is €3,000 or less or, if higher, there is no concealment.” “The penalty for a minor offence is a proportional monetary penalty of 50%.”) (art. 191.2 LGT)
It is not minor in these cases: «La infracción no será leve, cualquiera que sea la cuantía de la base de la sanción, en los siguientes supuestos:» (“The offence is not minor, whatever the amount of the penalty base, in the following cases:”) (art. 191.2 LGT)
(“a) When false or falsified invoices, receipts or documents have been used, even if this does not amount to fraudulent means.”)
(“b) When incorrectly kept books or records account for more than 10% of the penalty base.”)
(“c) When amounts withheld, or that should have been withheld, or payments on account have not been paid.”)
(“The penalty for a serious offence is a proportional monetary penalty of 50% to 100%, graded by raising the minimum percentage for repeated tax offences and financial loss to the Public Treasury, with the increases set for each case in article 187(1)(a) and (b) of this law.”) (art. 191.3 LGT)
(“The penalty for a very serious offence is a proportional monetary penalty of 100% to 150%, graded by raising the minimum percentage for repeated tax offences and financial loss to the Public Treasury, with the increases set for each case in article 187(1)(a) and (b) of this law.”) (art. 191.4 LGT)
The penalty reductions are in the table in section 2 and in section 4.

How long can the tax agency claim a return from me?

The right to assess the debt and the right to demand payment «Prescribirán a los cuatro años» (“expire after four years”) (art. 66 LGT).
When the period starts and which actions restart it, with the text of arts. 67.1 and 68 LGT, is in section 6.
