Independent residence application EX-02

Requirements, documents and steps for applying for independent residence in Spain.

Which form and ground do I choose?

Use EX-02 → “Residencia independiente de la persona reagrupante”.
Select your actual Article 69 ground and attach its proof; a job offer, separation or adulthood alone does not satisfy every ground.

Spouse, partner and children

Spouse/partner: at least one year of family authorization plus own qualifying means, employment or self-employment (Art. 69.1).
Children/legal wards: adulthood plus a qualifying Art. 69.1 condition, or adulthood plus five years in Spain (Art. 69.4).

Relationship ended, violence or death

Breakup normally requires a three-year relationship and one year together in Spain, with a common-child custody exception.
Art. 69.2 sets six-month filing clocks from the specified court/registry notice, victim-proof notice, or death. Keep that dated proof; violence and death do not share the ordinary one-year wait.

Parents and Blue Card families

Reunited parents need a work authorization route; the applicant/authority may depend on the work modification.
Blue Card families have a separate five-year EU residence condition, including the last two in Spain (Art. 69.5–6). Use the official independent-residence procedure for your branch.

Decision and card

Hoja 11 specifies three months with negative silence for spouse/child independent applications; a parent’s work modification follows its own procedure.
Read the exact approval or refusal. A pending application is not an independent grant; after approval, follow the TIE procedure stated in the decision.

What to do

Match your proof and filing clock to the exact independence ground.

Steps

  1. Match your permit and event to Article 69, not Article 99 or EU retention.
  2. Complete EX-02; attach full valid passport, family permit and ground-specific evidence.
  3. File at your residence-province Extranjería office or Mercurio; pay the applicable fee.
  4. Keep the receipt and monitor formal notices; after approval follow the card instructions in the decision.

RD 1155/2024 Art.69 separates spouse/partner, event, child, Blue Card and parent independence grounds. EX-02 records the ground; a parent’s work route can change applicant and authority.
