Spanish family independent residence — apply

A practical guide to applying independently after residence as a Spanish national's family member.

Can you always get independent residence?

No. Art. 99 excludes 94.1(c) stable partners and 94.1(i) other relatives.

Death: you must have resided in Spain before the death (Art. 99.2).

Violence uses Art. 99.5 proof — not a generic six-month clock.

Where and how do you file?

Mark the independent-retention box on EX-24 for your event.

File in person at Extranjería of your residence or intended-residence province — Hoja informativa 19.

If approved, keep your current TIE until it expires (Art. 99.6).

Who is excluded

Art. 99.1 excludes 94.1(c) and 94.1(i).

Death

Must have resided in Spain before the Spanish relative’s death.

Communicate death within six months; request independent within six months from the event.

Departure and education

Communicate the Spanish citizen’s departure within six months.
Children living and enrolled in Spain, and their parent with effective custody, retain authorization until the studies end (99.3).
Request independent residence within six months of the event (99.6).

Divorce or registered-partnership cancellation

Communicate divorce or registration cancellation within six months of the event.
Request independence within six months of notification admitting the court claim, or the registration-cancellation decision.
Prove one ground: relationship at least three years before proceedings, including one in Spain; custody of the Spanish citizen’s children; or valid visits to their minor child in Spain.

Your current TIE

Favorable independent grant: keep current TIE until expiry — not a new card within one month.

Modification if retention is unavailable

If eligible, request modification under Title XI within three months of the event, or within three months of an independent-residence refusal (99.7).

What to do

Match your event to Art. 99.2–99.5 before choosing the EX-24 box.

Bring

  • Passport
  • Current TIE if held
  • Event-specific official evidence
  • EX-24 with independent box
  • Address in competent province
  • Copies if requested

Steps

  1. Art. 99: confirm 99.1 exclusions.
  2. Map notification deadline vs six-month independent-request deadline for your event.
  3. EX-24: independent-retention box.
  4. Submit in person at Extranjería of residence or intended-residence province — Hoja 19.
  5. Check 99.7 modification eligibility; file within three months of the event or refusal if retention is unavailable.

Art. 99 event clocks differ; favorable grant keeps current TIE until expiry (99.6).
