Employee to self-employed Spain — Hoja 55 modification
Use this when the current work card does not already cover the self-employed activity.
Do I always need a modification to become self-employed?
No. Some renewed work authorizations already allow both employed and self-employed activity. If the card does not cover the planned activity, use the Hoja 55 branch.
Which legal rule controls this route?
Art. 192.2 is the access rule from employed work to self-employed work. Art. 191.3 is the modification rule for work-enabled residence and points to branch-specific work requirements.
Conditions
Art. 192.2 allows holders of residence and work for employed activity to request access to self-employed work without extending the modified authorization. Art. 191.3 is the modification rule for work-enabled residence and points to art. 80/art. 86 by branch.
Materials
Prepare EX-26, passport, current work authorization, business plan, investment and viability evidence, licences or professional credentials, and the tax/Social Security path for self-employment.
