Spain employee work permit - the employer carries the file

A Spanish job can support residence only when the employer, contract, position, and immigration channel fit. A job offer alone is not enough.

Is finding a job enough to get a work permit?

No. For residencia temporal y trabajo por cuenta ajena, the Spanish employer usually submits the initial authorization.
The file depends on the employer capacity, the contract, the job conditions, and the applicant documents.

Who submits the first application?

Usually the employer or its representative. The worker normally waits for authorization and then applies for the visa through the consulate.
Do not start work just because the paperwork has begun.

Who this fits

  • Applicants with a real Spanish employer ready to sponsor.
  • Roles with clear contract terms and employer capacity.
  • Workers whose credentials match the position.

Who should pause

  • People with only informal promises.
  • Applicants asked to pay for a fake contract.
  • Employers that do not understand their filing duties.

Costs

  • Work authorization fee, often employer-side for work authorization.
  • Visa fee and TIE card fee.
  • Translations, apostilles, criminal record, medical certificate.
  • Lawyer or gestor fee if the employer uses representation.

Handling routes

  • Employer HR or lawyer: standard path.
  • Worker self-check: confirm the employer actually accepts sponsorship.
  • Professional review: small employer, regulated job, prior refusal, in-Spain status change.

What to do

Confirm the employer willingness before you build your own file.

Bring

  • Signed or draft employment contract.
  • Employer company and tax/Social Security documents.
  • Worker passport.
  • Qualifications or professional credentials when relevant.
  • Criminal record and medical certificate for visa stage.
  • Authorization and visa fee receipts.

Steps

  1. Ask whether the employer will sponsor and submit the authorization.
  2. Check the contract, salary, occupation, location, and start date.
  3. Collect applicant documents: passport, qualifications, criminal record, medical certificate.
  4. Let the employer submit the authorization and pay the employer-side work fee when applicable.
  5. After approval, apply for the visa, enter Spain, complete Social Security and TIE steps.

RD 1155/2024 art. 72 defines temporary residence and employee work; art. 73 sets the initial authorization and Social Security registration logic; arts. 74-79 regulate requirements, procedure and effects. The employer-backed offer is the legal engine of the initial file.

Can I apply while in Spain as a tourist?

Do not assume. The initial employee route is often built from outside Spain unless a specific modification or exception applies.

Can my family come?

Family routes may be possible, but they depend on the granted authorization, funds, and family documents.

What if the employer withdraws?

The file can collapse if the sponsoring employer is no longer real or willing. Get professional review before changing facts mid-process.
