Invitation letter overstay: when is the host responsible?

Overstay is a guest stay problem first; host liability under LO 4/2000 art. 53.2.c needs specific facts — not automatic fines or zero duty.

When can the inviting host face sanctions?

LO 4/2000 art. 53.2.c targets promoting irregular stay after legal entry on the host’s express invitation while the guest remains their charge past visa/stay time.
Overstay alone does not establish host liability; the conduct and support conditions also matter.
Empadronamiento or staying at the address does not legalize excess stay.

Invitation dates do not extend permission to stay

The dates planned in the invitation describe the visit. They do not extend the visitor’s visa or stay authorisation.

  • Keep the planned itinerary and the documents establishing permitted stay as separate records.

What to do

Confirm allowed stay dates first, then whether host facts match art. 53.2.c.

Bring

  • Passport and entry/exit records
  • Visa or stay/residence authorisation
  • Issued invitation letter
  • Records of the visitor’s support arrangements
  • Any actual administrative notice

Steps

  1. Guest: compare passport stamps, visa dates, and any entry stamp against today.
  2. Host: review what you declared in the invitation and whether the guest is still your charge.
  3. If you receive a notice, save it and check its authority, stated grounds and response deadline.
  4. Check whether the host promoted irregular stay; overstay alone does not establish all elements.
  5. For lawful travel planning, use the entry documents guide.

LO 4 art. 53.2.c requires promotion of irregular stay after legal entry on the offender’s express invitation, with the visitor remaining at their charge beyond the permitted visa or authorisation period.
