Unemployment benefits in Spain for foreigners: eligibility
Nationality alone does not decide entitlement. Check your right to work, contributions, legal unemployment status and jobseeker registration.
Can foreigners claim unemployment benefits in Spain?
Yes, if they meet SEPE and Social Security requirements. A TIE card alone does not prove entitlement; check that you have authorised work, qualifying contributions, and active job-seeker registration.
What are the requirements for a foreigner to receive unemployment benefits in Spain?
You must be legally resident or otherwise legally present in Spain, be legally unemployed, and meet SEPE’s requirements for contributions, registration, and availability for work.
Do I need a valid work permit to receive unemployment benefits?
SEPE requires that your immigration status allows you to reside or stay legally in Spain. Check with the Immigration Office that your permit and renewal status are compatible with your situation.
Can I claim unemployment benefit if I worked in another EU country first?
Periods worked in the EU, EEA, or Switzerland may be coordinated through the U1 document or an exchange between institutions. SEPE must assess which contributions can be combined in your case.
Do EU citizens qualify for unemployment benefits under the same rules?
Yes. Entitlement is assessed under SEPE’s general rules: legal unemployment, qualifying contributions, registration as a job seeker, and availability for work.
What to do
Do not treat a TIE alone as proof of paro entitlement.

- File with SEPE
Basis

More questions
Is a valid TIE card enough to claim unemployment benefits?
No. You must also meet the requirements for unemployment, contributions, and job-seeker registration.
What documents should I take to a SEPE appointment?
Bring valid identification, your Immigration Office decision or renewal receipt where relevant, bank details, and any employment documents SEPE requests to confirm your situation.
Is an NIE number enough to apply for unemployment benefits?
No. An NIE identifies you, but it does not by itself prove legal residence or entitlement to unemployment benefit. SEPE will also check your contributions, unemployment status, and active registration.
Can I leave Spain while receiving unemployment benefits?
You must tell SEPE before leaving Spain. Depending on the reason and duration, contributory benefit or a subsidy may continue, be suspended, or end.
