Spain student stay - study first, then handle the card
Use this route only when the real purpose is study or training. The school, course, funds, insurance, and TIE step must all fit.
Is a student stay a residence route?
No. Estancia por estudios is a long-stay authorization for study, training, mobility, volunteering, or similar approved activities.
It can lead to a TIE and later changes of status, but the first file is judged as a study file, not as a general immigration shortcut.
Can I apply from inside Spain?
Sometimes. The current Migraciones sheet allows study-stay applications in Spain in specific conditions, but timing and legal-entry status matter.
If you are outside Spain, the normal channel is the Spanish consulate that covers your place of residence.
Who this fits
- Admitted students with a real course in Spain.
- Language, university, vocational, exchange, training, or similar applicants whose activity can be documented.
- Families who can prove funds and insurance without inventing work income.
Who should pause
- People using a weak course only to enter Spain.
- People planning to work full-time from day one.
- People already in Spain near the end of their legal stay.
Costs
- Official visa or authorization fees.
- TIE card fee after arrival when required.
- Tuition, insurance, sworn translation, legalization or apostille, criminal record, medical certificate.
- Lawyer, gestor, or school service fees are private service fees, not official fees.
Handling routes
- DIY: clean admission, clean funds, clear consulate checklist.
- School support: useful for university and recognized programs.
- Lawyer or gestor: useful for in-Spain filing, family members, prior refusal, or later status-change planning.
What to do
Prove that the course is real before you spend money on the visa file.
Bring
- Passport valid for the planned stay.
- Admission letter and course details.
- Tuition payment or enrollment proof when required.
- Funds for the stay and, if relevant, family members.
- Health insurance accepted for immigration purposes.
- Criminal record and medical certificate when the channel requires them.
Steps
- Confirm the school, course, start date, duration, attendance mode, and tuition status.
- Check whether your case goes through a consulate or through extranjería in Spain.
- Prepare funds, health insurance, passport, and legalized or apostilled civil/criminal documents.
- File the visa or authorization before your legal timing window closes.
- If the stay exceeds six months, enter Spain and book the TIE step.
Basis
RD 1155/2024 art. 34 regulates the long-stay study visa, art. 36 sets the consular procedure, art. 52 defines the long-duration study stay, and arts. 55-58 cover duration, renewal/family and specific study cases. The activity, timing, funds, insurance, and later card step must fit that framework.
More questions
Can I work while studying?
Do not assume. Use RD 1155/2024 art. 52 activity type and the Migraciones sheet to check whether work is compatible with the study stay, hours, and course purpose.
Do I need a TIE?
If the authorization is for more than six months, plan for the TIE step after entry. For shorter stays, the visa/resolution and consulate instructions decide the practical proof you carry.
Can my family come with me?
Possibly, but their file depends on your student authorization, funds, insurance, and family documents. Do not prepare the main applicant alone if the family will travel together.
