When to file and how — timing, channels and documents

Route-first filing timing, channels and base documents before route-specific evidence.

When is the filing window?

For ordinary temporary residence renewals, the standard window is the two months before expiry. Student status is a prórroga de estancia and must be checked with the student guide, not treated as generic residence renewal.

What happens if I file late?

For ordinary renewal routes, filing up to three months after expiry may still be accepted but carries infraction risk. More than three months after expiry usually means the authorization is extinguished. If you already filed before that point, follow the pending/status path instead.

What channels can I use?

Mercurio online filing, in-person filing at Oficina de Extranjería, or registered postal submission through Correos. The channel does not replace the route-specific evidence.

Conclusion

Classify your route before using timing rules. Work, family, non-lucrative and arraigo renewals commonly use the two-month-before / three-month-after renewal frame. Student status is a prórroga de estancia and needs its own timing and silence reading.

First: identify the route

Do not start from the plastic card date alone. Identify whether you are renewing an ordinary residence authorization, extending student stay, correcting a pending file, responding to a requerimiento, or moving toward modification. The filing window is useful only after that classification.

Ordinary renewal window

For ordinary temporary residence renewal routes, file during the two months before the authorization expires. Filing in the applicable window generally extends the previous authorization until resolution. Work rights and status depend on the route being renewed and the filing receipt.

Student prórroga caveat

Student status is not ordinary residence renewal. Use the student extension guide for prórroga de estancia, evidence of study continuity, and its specific status/silence consequences. Do not assume the generic 3-month positive-silence renewal rule applies to studies.

Late filing: three-month tolerance

If you miss the pre-expiry window, ordinary renewal filing may still be accepted up to three months after expiry, with possible infraction risk. Beyond three months, the authorization is usually extinguished and ordinary renewal may no longer fit. If the file was already submitted before this point, read the status guide instead of treating the case as unfiled.

Filing channels

Three ways to file:
1. Mercurio — online portal, requires Cl@ve or digital certificate. Generates an instant digital receipt.
2. In-person — at the Oficina de Extranjería with a cita previa. You receive a stamped paper receipt.
3. Postal — registered mail via Correos to the competent office. The postal receipt serves as proof of filing date.

Base document checklist

Base documents usually include the form, passport copy, current TIE or resolution, paid fee, padrón where required, and route-specific evidence. Student, work, family and non-lucrative routes do not use the same decisive evidence.

What the filing receipt means

The filing receipt is proof of filing date and may preserve status while the file is pending. It is not a new card, not a travel authorization, and not proof that the file is approved. For travel, check autorización de regreso rules.

What to do

Classify your route before filing. Use the ordinary renewal window only after confirming this is not a student prórroga, card-only step, pending file or modification case.

Bring

  • Current route identified
  • Student prórroga checked separately if relevant
  • Expiry/status classified
  • Filing channel chosen
  • Cl@ve or certificate ready if using Mercurio
  • EX form and fee prepared
  • Passport and current TIE/resolution copied
  • Route-specific evidence gathered
  • Filing receipt stored safely
  • Status guide bookmarked for after filing

Steps

  1. Identify the current route from the resolution or card: work, family, non-lucrative, arraigo, student, long-term card or unsure.
  2. If it is student status, open the student extension guide before using ordinary residence-renewal timing.
  3. For ordinary renewal routes, work from the two-month pre-expiry window and the three-month late-filing tolerance, not from a generic 60/90-day shortcut.
  4. Choose the filing channel: Mercurio, Oficina de Extranjería or registered postal submission.
  5. Prepare base documents plus route-specific evidence; the channel does not replace the evidence.
  6. After filing, keep the receipt and follow the status guide if the case is pending, archived, denied or approved.

Ordinary renewal timing must be read by route. Student stay extension is a prórroga de estancia and should not be folded into the generic temporary-residence renewal timing or 3-month positive-silence narrative.

Should students use this timing checklist?

Use it only as orientation. Student status is prórroga de estancia, not ordinary residence renewal. Open the student extension guide before filing.

Does this page decide whether I need renewal or modification?

No. If work, studies, family or work rights changed, compare renewal vs modification before using the filing checklist.

Does the receipt prove approval?

No. The receipt proves filing date and can preserve status while pending. It is not a new card, not travel authorization and not proof of approval.
