Renewal denied — appeal and remedy paths
Your renewal was denied. Understand why, know your deadlines, and choose the right remedy.
What are my options after denial?
Two main paths:
1. Recurso de alzada (administrative appeal) — filed with the same body, decided by the superior. Free. 1-month deadline.
2. Recurso contencioso-administrativo (judicial appeal) — filed at the court. Requires a lawyer. 2-month deadline.
Does denial end my provisional rights?
Yes. Once denial is notified, any provisional work authorization or card validity extension ceases.
However, if you file a recurso de alzada, the administration may suspend the effects of the denial while the appeal is pending.
Can I re-file instead of appealing?
Sometimes. If the denial reason is curable (missing document, insufficient evidence), a new filing may be faster than an appeal. But you lose the original filing date and its protective effects.
Conclusion
Denial is not the end. You have two appeal paths with strict deadlines. Choose based on whether the denial reason is factual error (administrative appeal) or legal disagreement (court).
Read the denial letter first
The resolución desfavorable must state the legal basis and the specific facts behind the denial. This determines your remedy:
• Factual error or missing document → recurso de alzada is usually enough.
• Substantive legal disagreement (e.g. the office interprets a rule differently) → contencioso-administrativo.
Recurso de alzada
Deadline: 1 month from notification of denial.
Filed with: the same office that issued the denial, or the superior body.
Cost: free (no court fees, no mandatory lawyer).
Decision: the superior body decides within 3 months. If no decision → negative silence (deemed denied).
Effect: filing the appeal does not automatically suspend the denial. You can request suspension, which the administration may grant if there are grounds.
Recurso contencioso-administrativo
Deadline: 2 months from notification of denial (or 2 months from the deemed denial of the alzada).
Filed at: Juzgado de lo Contencioso-Administrativo in the province.
Cost: requires a lawyer (abogado) and court representative (procurador). Legal aid (justicia gratuita) available if you qualify.
Decision: the court decides. Timeframes vary (months to years).
Effect: the court can suspend the denial as a precautionary measure (medida cautelar) if you demonstrate urgency.
Re-filing vs appealing
If the denial reason is curable — a missing document you now have, evidence that was incomplete — filing a new renewal application may be faster than waiting for an appeal.
Trade-off: re-filing loses your original filing date. If that date matters (e.g. it was within the 60-day window), appeal may be better.
Practical steps immediately after denial
1. Note the notification date — your deadlines start now.
2. Read the denial reason carefully.
3. Decide: appeal or re-file.
4. If appealing, prepare the recurso de alzada within 1 month.
5. If re-filing, prepare a stronger file addressing the denial reason.
6. Consider consulting an immigration lawyer if the denial involves a legal interpretation.
What to do
Read the reason. Count the deadline. Choose your remedy. Do not freeze.
Bring
- Denial notification date recorded
- Denial reason identified
- Deadline calculated (1 month for alzada, 2 months for contencioso)
- Remedy path chosen (appeal vs re-file)
- Documents preserved
- Lawyer consulted if legal complexity
Steps
- Note the exact notification date of the denial.
- Read the denial letter and identify the specific reason.
- If factual/documental error, prepare recurso de alzada within 1 month.
- If legal disagreement, consult a lawyer about contencioso-administrativo (2-month deadline).
- If the reason is curable and speed matters, consider re-filing instead of appealing.
- Keep all documents — the denial letter, the original filing receipt, all correspondence.
Basis
Art. 121 of Ley 39/2015 establishes the recurso de alzada with a 1-month deadline and 3-month resolution period. Art. 46 of the Ley de la Jurisdicción Contencioso-Administrativa sets the 2-month deadline for judicial appeal.
More questions
Can I keep working while appealing?
Not automatically. Denial ends provisional work authorization. You can request suspension of the denial in the appeal, but it is not guaranteed.
Is legal aid available?
Yes. If your income is below the threshold, you can apply for justicia gratuita, which covers lawyer and procurador fees for the contencioso-administrativo.
What if I was denied because of absences from Spain?
This is a substantive reason. A recurso de alzada is worth trying if you have evidence of justified absences. If the office rejects it, contencioso-administrativo is the next step.
