Non-lucrative renewal — what if you left Spain too long?
Non-lucrative residents must stay in Spain at least 183 days per year. Falling short puts your renewal at risk.
How does the 183-day rule affect my renewal?
Non-lucrative authorization requires you to reside effectively in Spain — meaning at least 183 days per calendar year.
If you spent more than 182 days outside Spain in any year of the authorization period, the administration may consider you did not maintain effective residence and deny renewal.
The count is based on entry/exit stamps in your passport and Schengen border records.
What if I exceeded the limit?
If you were absent for medical treatment, family emergency, or professional reasons, document the cause and duration.
Justified absences may be accepted, but there is no automatic exemption. Prepare a written explanation with supporting evidence (medical records, family documents, etc.).
What to do
Count your days outside Spain before filing.
Steps
- Review passport stamps for all exits/entries during the authorization period
- Calculate total days outside Spain per calendar year
- If over 182 days in any year, prepare justification and evidence
- Include the explanation letter with your renewal file
Basis
Art. 75 RD 1155/2024 requires effective residence in Spain; Art. 162 CC defines habitual residence as 183+ days in a calendar year.
